Overview
The law prohibiting discrimination applies to all employers regardless of size and resources and protects all employees, workers, consultants and job applicants.
Compensation awards for discrimination are potentially unlimited and the cost of claims (in terms of legal costs, time costs and reputational damage) can be significant. Good employers can find themselves inadvertently liable for discrimination where, for example, there has been harassment, a mismanaged recruitment process or where seemingly appropriate management decisions have a detrimental impact on a particular group of staff.
